Welcome to Near. By downloading or using our app, you agree to these Terms of Service. Please read them carefully.

1. Eligibility

You must be at least 18 years old to use Near. By creating an account, you confirm that you are 18 or older. We reserve the right to terminate accounts of users found to be under 18.

2. Account Responsibilities

You are responsible for:

• Maintaining the security of your account credentials
• All activity that occurs under your account
• Providing accurate information during registration
• Keeping your contact information up to date

3. Community Guidelines

You agree not to use Near to:

• Harass, threaten, or harm other users
• Send spam, unsolicited messages, or links
• Share hate speech, slurs, or discriminatory content
• Impersonate other people or entities
• Share explicit, pornographic, or inappropriate content
• Stalk or track other users
• Violate any applicable laws or regulations
• Attempt to bypass our safety or security systems

4. Strike System & Enforcement

Violations of our community guidelines result in strikes against your account:

• First strike: Warning notification
• Second strike: Final warning
• Third strike: Temporary DM suspension (10 days for free users, 3 days for premium)
• Repeated violations: Extended suspensions or permanent ban

We reserve the right to immediately terminate accounts for severe violations including hate speech, threats of violence, or illegal activity.

5. Location Services

Near requires access to your device's location to function. By using Near, you consent to our collection and processing of your location data as described in our Privacy Policy. You retain full control over when and how your location is used:

• Go invisible: You may toggle invisibility off at any time from your profile settings. While invisible, Near stops tracking and sharing your location entirely — though you can still view nearby users.
• Custom Hours: You may configure a daily active-hours window in your settings (for example, 8am–9pm). Near will only collect and process your location during that window. Outside your chosen hours, location services are fully off and you will not appear in other users' nearby feeds.

Disabling location access entirely through your device settings will limit the app's core functionality.

6. Subscriptions & Payments

Near offers premium subscription plans ($9.99/month and $14.99/month) and one-time purchases (Profile Boost at $3.99). By purchasing a subscription:

• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• Payments are charged to your App Store or Google Play account
• Refunds are subject to Apple App Store and Google Play Store policies
• We reserve the right to change pricing with 30 days notice

7. Advertising

Free users will see rewarded video advertisements when unlocking profile information. These ads are provided by Google AdMob. By using the free tier, you consent to viewing these advertisements.

8. Intellectual Property

Near and all associated logos, designs, and content are the intellectual property of Near. You may not copy, modify, or distribute our content without written permission.

9. Disclaimers

Near is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for the conduct of other users on the platform.

10. Limitation of Liability

To the maximum extent permitted by law, Near shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

11. Changes to Terms

We may update these Terms from time to time. Continued use of Near after changes constitutes acceptance of the new Terms.
